~ ~ ~ .<.~::~T.~.~, .ra,~= ~ ~.~1:~:~q:?.~.~,~ ~ ~::: --,:. ~=~ . . k PAGE 2 THE FLORALA NEWS- WEDNESDAY, OCTOBER 31, 2018 The Florala Police Department re- ported the following arrests for October 11-30, 2018: Terrence Rogers - domestic vio- lence III Carlton Palmer - throwing into an occupied vehicle Ronnie Lee Norris - possession of controlled substance, possession of marijuana, possession of drug para- phernalia Orlacion Marie Sinkfield - failure to appear Paula Medley - failure to appear Rachel Price Boggett - possession of marijuana II, possession of drug par- aphernalia Shasta Nichole Haynes - warrant ***All subjects listed above are in- nocent until proven guilty in a court of law. A Covington County jury convicted Grady Mar- shall Cotton, 62, of Opp, AL, of Possession of Mari- juana I and Possession of Drug Paraphernalia on October 23. The evidence at trial showed that on October 13, 2015, Agents with the 22nd Judicial Circuit Drug Task Force went to a residence on Cummings Avenue in Opp on reports of suspected drug activity. Testimony revealed that while agents made contact with the homeowner, Commander Mark Odom located Cotton also on that property. Upon subsequent investigation, Odom recovered an amount of marijuana from Cotton's pocket. The State's evidence also showed that Cotton had been previously convicted for Possession of Marijuana II, making this subsequent possession a felony of- fense. Cotton also has a prior felony conviction for Possession of Marijuana I. The jury deliberated for only about fifteen min- utes before returning its guilty verdict. Assistant District Attorney Nikki Stephens prosecuted the case. The defendant was represented by David Baker of Laird, Baker & Blackstock in Opp. Cir- cuit Judge Lex Short presided over the case. During jury selection on Monday, much of the State's voir dire was directed at revealing poten- tial jurors' opinions on the use and]or legalization of marijuana. Stephens said, "Possession of any amount of marijuana, for any reason, is currently against the law in the State of Alabama. Officers and prosecutors are charged with upholding that law, and the jury properly applied the law to the f !!iii!ii! iii facts of the case in returning its verdict- disregard- ing any popular public opinion about what anyone [i thinks the law should be. Stephens wished to ex- press her appreciation to the Drug Task Force for Ill ii : i: i: iiiiiiiiiiiiiiiiiiii!i iii the work they do in keeping drugs out of our com- munity. District Attorney Walt Merrell commended Ste- phens for obtaining justice in what was her first solo jury trial. "Nikki came to us about a year ago. She graduated #2 in her law school Class and I knew she was a gem when we hired her. The way she handled this trial shows what an asset she is to the people of Covington County." Judge Short set a sentencing hearing for Decem- ber 6, 2018. Possession of Marijuana I at the time this offense was committed was a Class C felony; Possession of Drug Paraphernalia is a Class A mis- demeanor. This is too far.
